CONDITIONS DE RESERVATION D&rsquo;UN STAGE DE FORMATION<\/strong><\/p><p>L&rsquo;inscription \u00e0 un stage de formation n&rsquo;est d\u00e9finitive qu&rsquo;apr\u00e8s r\u00e9ception : du devis rev\u00eatu de la mention \u00ab\u00a0bon pour accord\u00a0\u00bb.<\/p><p>Dans le cas d&rsquo;une prise en charge de l&rsquo;action par un organisme mutualiste, le ch\u00e8que d&rsquo;acompte est conserv\u00e9 au titre de la \u00ab\u00a0garantie de r\u00e9servation\u00a0\u00bb et ne sera encaiss\u00e9 que dans le cas d&rsquo;un d\u00e9sistement tel qu&rsquo;envisag\u00e9 \u00e0 l&rsquo;article 4.<\/p><p>Un \u00e9ch\u00e9ancier peut \u00eatre propos\u00e9 par le centre de formation, mais en aucun cas, le r\u00e8glement ne peut se poursuivre post-formation \u00e0 l&rsquo;exception d&rsquo;accord express et pr\u00e9vu initialement au contrat ou \u00e0 la convention.<\/p><p><strong>2. MODALITES D&rsquo;ACCEPTATION D&rsquo;UN STAGE<\/strong><\/p><p>La signature du devis vaut des presentes conditions generales de vente et prise de connaissance des pre requis necessaires pour suivre la formation consideree.<\/p><p><strong>3. CONVOCATION DES PARTICIPANTS<\/strong><br \/>Elle est adress\u00e9e au plus tard\u00a0dans les 48 heures\u00a0qui pr\u00e9c\u00e9dent le d\u00e9but du stage except\u00e9 dans le cas d&rsquo;une r\u00e9servation de stage en dernier lieu ou de circonstances exceptionnelles.<\/p><p><strong>4. MODALITES D&rsquo;ANNULATION PAR LE CLIENT<\/strong><br \/>Tout devis ou document contractuel \u00e9manant de AREP FRESC et retourn\u00e9 par le client avec son \u00ab\u00a0bon pour accord\u00a0\u00bb vaut acte de r\u00e9servation\u00a0pour le stage consid\u00e9r\u00e9 .<\/p><p>En vertu de ce principe, et dans le cas de salari\u00e9s d&rsquo;entreprise,\u00a0cette derni\u00e8re s&rsquo;engage \u00e0 lib\u00e9rer le ou les salari\u00e9s aux dates et heures indiqu\u00e9es. Dans le cas contraire, l&rsquo;acompte de formation vers\u00e9 sera conserv\u00e9 int\u00e9gralement \u00e0 titre d&rsquo;indemnit\u00e9 forfaitaire si le stage est d\u00e9command\u00e9 pour tout ou<\/p><p>partie dans un d\u00e9lai inf\u00e9rieur \u00e0\u00a05 jours\u00a0en dehors des cas de force majeure.<br \/>Toute annulation, pour \u00eatre effective, devra \u00eatre\u00a0confirm\u00e9e\u00a0par lettre, t\u00e9l\u00e9copie, e-mail ou tout autre moyen susceptible d&rsquo;apporter une preuve tangible.<\/p><p><strong>5. VALIDITE DES OFFRES<\/strong><br \/>Concernant les co\u00fbts, les devis ont une dur\u00e9e de validit\u00e9 de\u00a03 mois. Les dates sont donn\u00e9es\u00a0\u00e0 titre indicatif. Elles ne sont consid\u00e9r\u00e9es comme d\u00e9finitives qu&rsquo;apr\u00e8s la validation du centre \u00e0 compter de la r\u00e9ception du pr\u00e9sent devis rev\u00eatu du \u00ab bon pour accord \u00bb et de l&rsquo;acompte de formation ou de l&rsquo;accord de prise en charge d&rsquo;un organisme collecteur. L&rsquo;absence de l&rsquo;une ou l&rsquo;autre de ces conditions autorise le centre de formation \u00e0 suspendre son engagement de formation. De m\u00eame, une r\u00e9servation n&rsquo;est consid\u00e9r\u00e9e comme effective que si l&rsquo;accord parvient dans une agence de AREP FRESC\u00a0au moins 5 jours\u00a0avant le d\u00e9but de la formation pr\u00e9vue au devis. Dans le cas d&rsquo;une confirmation plus tardive, le centre ne garantie pas une inscription aux dates propos\u00e9es.<\/p><p>Les inscriptions sont r\u00e9alis\u00e9es\u00a0au fur et \u00e0 mesure\u00a0de l&rsquo;arriv\u00e9e des dossiers d&rsquo;inscription. Pour \u00eatre consid\u00e9r\u00e9 comme inscrit, un candidat doit satisfaire \u00e0 l&rsquo;entit\u00e9 des conditions pr\u00e9vues initialement ( \u00ab bon pour accord + modalit\u00e9s de r\u00e8glement \u00bb). Dans le cas contraire, et d\u00e8s le remplissage du stage au volume d\u00e9fini par AREP FRESC, le centre n&rsquo;est pas tenu d&rsquo;accepter l&rsquo;inscription d&rsquo;un candidat. Seule la convocation par le centre de formation vaut engagement en formation \u00e0 l&rsquo;exception des cas pr\u00e9vus \u00e0 l&rsquo;article 6.<\/p><p><strong>6. ANNULATION PAR AREP FRESC<\/strong><\/p><p>AREP FRESC se r\u00e9serve le droit de sous-traiter, de reporter une session pour pr\u00e9server un meilleur \u00e9quilibre du stage, dans le cas de l&rsquo;atteinte du nombre de candidats initialement pr\u00e9vu ou d&rsquo;annuler pour des raisons g\u00e9n\u00e9rales d&rsquo;organisation (notamment dans les cas de force majeure). Dans ce cas, et si l&rsquo;action ne peut \u00eatre reconduite dans un d\u00e9lai de trois mois, les sommes d\u00e9j\u00e0 vers\u00e9es seraient int\u00e9gralement revers\u00e9es. Dans le cadre d&rsquo;une sous-traitance, AREP FRESC reste le garant de la correcte r\u00e9alisation de l&rsquo;action de formation.<\/p><p><strong>7. FACTURATION<\/strong><br \/>Tout stage commenc\u00e9 est factur\u00e9 dans\u00a0son entier. En aucun cas le centre de formation n&rsquo;est tenu \u00e0 la prise en charge de frais annexes, g\u00e9n\u00e9r\u00e9s par la formation et notamment ceux d\u00fbs au titre du d\u00e9placement et quelles que soient les causes qui l&rsquo;aient occasionn\u00e9.<\/p><p>La facture est pr\u00e9sent\u00e9e\u00a0en d\u00e9but de formation\u00a0et doit \u00eatre dans tous les cas acquitt\u00e9e\u00a0avant la fin de l&rsquo;action. Elle tient lieu de\u00a0convention simplifi\u00e9e. A l&rsquo;initiative du centre ou \u00e0 la demande du client, une convention de formation peut \u00eatre r\u00e9alis\u00e9e.<\/p><p>Tout paiement diff\u00e9r\u00e9 au del\u00e0 des \u00e9ch\u00e9ances initiales sera major\u00e9 de plein droit et sans autre avis d&rsquo;un int\u00e9r\u00eat de 1.50 % par mois de retard. Pour les professionnels, conform\u00e9ment aux dispositions pr\u00e9vues aux articles L. 441-3 et L. 441-6 du Code du commerce relatifs \u00e0 l&rsquo;indemnit\u00e9 forfaitaire pour frais de recouvrement, une somme de 40 euros net de TVA sera appliqu\u00e9e en sus des p\u00e9nalit\u00e9s l\u00e9gales..<\/p><p>Les attestations de formation sont d\u00e9livr\u00e9es \u00e0 l&rsquo;issue des formations. Par contre les certificats de fin de formation de type, FIMO, FCO (Arr\u00eat\u00e9 du 31\/3\/1998), Caces ou tous autres certificats requis par les pouvoirs publics ou autres instances pour l&rsquo;exercice ou la pratique de certaines activit\u00e9s\u00a0ne sont d\u00e9livr\u00e9es que lorsque la facture \u00e9mise correspondant \u00e0 ladite formation est d\u00fbment acquitt\u00e9e. Dans l&rsquo;attente, ce justificatif est conserv\u00e9 par le centre de formation au titre d&rsquo;une \u00ab garantie de paiement \u00bb.<\/p><p><strong>8. INCIDENTS EN FORMATION<\/strong><\/p><p>En aucun cas, la responsabilit\u00e9 d&rsquo;un intervenant ou du centre formation ne peut \u00eatre engag\u00e9e pour des dommages mat\u00e9riels ou corporels dans le cadre de la r\u00e9alisation de formations intra ou inter entreprise \u00e0 l&rsquo;occasion d&rsquo;exercices ou manoeuvres r\u00e9alis\u00e9s avec des mat\u00e9riels ou v\u00e9hicules de l&rsquo;entreprise.<\/p><p><strong>9. LITIGES<\/strong><\/p><p>En cas de litige, seuls les tribunaux du ressort du si\u00e8ge social du centre de formation sont
